Enforcement and establishing or nullifying validity

 

Our services with regard to the enforcement and defense of IP rights include patent infringement and license fee lawsuits in Hungary, preliminary injunction proceedings, obtaining a compulsory license, enforcing prior user’s rights, representing clients in ownership disputes, representing clients when they wish to nullify or defend the validity of a patent as well as in special non-infringement proceedings.

Our services with regard to the enforcement and validity of rights include the followings:

• representing clients both as plaintiffs or defendants in patent infringement cases;

• obtaining preliminary injunctions either separately or within a patent infringement lawsuit;

• obtaining customs measures of patent rights in actions before the customs authorities;

• representing clients in patent nullity (revocation) proceedings;

• representing clients in proceedings for obtaining a compulsory license;

• representation clients in enforcing prior users rights;

• proceedings initiated between inventors and their employers for the remuneration of inventors;

• representing clients in proceedings for the declaration of non-infringement;

• court proceedings for the change of inventorship or right to a patent, including changes in the proportion of inventorship;

• representing clients in out-of-court settlements in connection with the above proceedings;

• representation before the EPO in opposition and appeal proceedings.
