The plaintiff is the Polish owner of the international device mark SATEL registered in 2001. He sued the defendant in 2008, whose predecessor let the domain name “satel.hu” registered in 2001 and since 2000 he in commerical contact with the exclusive agent in Hungary of the plaintiff in Hungary. The plaintiff is registered owner of the domain name “uzleticegtudakozo.hu” (business inquiry). Three years later the defendant started to use the domain name “uzleticegtudakozo.com”. The plaintiff sued the defendant for unfair competition. Unsuccessful attempt to participate in the reputation of mark PANNÓNIA
The Hungarian mark PANNÓNIA used for cheese is well-known, an opinion poll made a few years ago resulted that it is known by 77 p.c. of the Hungarian population. This was probably the motivation of a competitor, called Tolle, to file a device mark with the word element TOLLE-PANNÓNIA, also for cheese. Despite the opposition filed by the owner of the mark PANNÓNIA the sign was registered.

Specification of goods in a trademark application
In the majority of countries which are parties of the Madrid Agreement on international registration of trademarks it is usual to indicate in the application the goods to be protected using „class headings” i.e. a general indication of the fields to which the goods and services in principle belong. HUNGARY will join the London Agreement on January 1, 2011
European Patents granted thereafter can be validated by translating the claims only, provided that the description is in English. If it is other than English, the English translation of the description (and drawing copies) must be filed together with the Hungarian claims.
The official fee schedule has not been published so far.
